As part of the day to day business operations of Armor Insurance Services, LLC “AIS”, including operation of the AIS web and micro site(s), we receive and maintain certain information regarding our subscribers and members. Information received from the AIS web site depends in part on what you do when you visit or transact business on the AIS web site. AIS respects the privacy of every individual who visits our web site. Therefore, we would like to define the types of information we receive and describe how it is maintained in this privacy policy (“Privacy Policy”). This policy refers only to the information collected and maintained from this Web site.

USING THIS WEB SITE CONFIRMS YOUR CONSENT AND AGREEMENT TO OUR PRIVACY POLICY, INCLUDING COLLECTION, USE AND DISCLOSURE OF INFORMATION BY AIS AS DESCRIBED HEREIN. YOUR USAGE ALSO SIGNIFIES YOUR COMPLIANCE WITH OUR USER AGREEMENT.

  • Guests – Users of our web site often visit solely to obtain general information about AIS’s operations and services. If you visit our web site to read or download information, you enter our site as a guest. As a guest, we collect and store only the following information: the name of the domain from which you access the Internet (for example: aol.com, if you connect from an America Online account), the date and time you accessed our site, your browser type, your operating system type, some of your software versions affecting site performance and the Internet address of the web site from which you linked directly to our site. We use this information to measure the number of visitors to the different sections of our site and to help us make our site more useful to visitors.

 

  • Members  – Users who currently have health insurance coverage through AIS (or would like to apply for coverage through AIS) can access our web site and conduct transactions with insurance carriers.  These transactions include:  Submitting an application for coverage; check claim status, referrals and pre-authorizations; verify benefit information; and pay premiums. Prior to utilization of these services, the insurance carrier may ask for personal information (such as date of birth, social security number, name, address with zip code, telephone number and e-mail address) to verify appropriate usage. AIS, its employees or affiliates will not have access to your user name and password that you create, unless you elect to share that password with a staff member for the purpose of assisting you with your application or providing administrative services on your behalf..

 

  • Users Under 13 Years of Age  – AIS often covers minor dependents through their parent or legal guardian’s health insurance policy. Children under the age of 13 can access our site as guests. Should they wish to use a service or feature available through the AIS web site, we require that they do so with the permission of their legal guardian (i.e. user name and password of legal guardian). AIS will not knowingly collect or use any personal information regarding a user under the age of 13 without the consent of a parent or guardian.   • E-Mail (Requests and Submissions) – Many of our members and guests may want to receive information such as new product offerings, Medicare and individual major medical insurance sales kits, health education and newsletters via email. AIS does collect email addresses on members and guests to provide this type information electronically. AIS will also utilize email to members and guests so we can perform surveys and/or gather other general information. Members or guests who do not want to receive electronic information or surveys may opt-out, by sending an e-mail to info@armorhealth.com.

 

  • Statistical Data  – AIS continually strives to enhance the features and services that are offered to our web site users. In an effort to determine the effectiveness and functionality of our web site, we monitor aggregated data regarding the use of our web site. For instance, we track the number of visits to a certain page; direct links from other web sites; and frequency of usage for independent services (i.e. claim status, application for coverage, etc). We may share statistical data with our affiliates, brokers, and providers for marketing purposes and the improvement and promotion of our web site services. Although we reserve the right to share this information as indicated above, this statistical data, including questionnaires and surveys, does not contain any personal information that could disclose the user’s identity.

Disclosure of Non-Public Personal Information:

We restrict access to nonpublic personal information unless it is needed to complete a transaction that our member has authorized (i.e. application submission, claims administration, adjustment and management; detection, investigation or reporting of actual or potential fraud; misrepresentation or criminal activity; underwriting; policy placement or issuance; loss control; ratemaking and guaranty fund functions; reinsurance and excess loss insurance; risk management; case management; disease management; quality assurance and improvements; utilization review, actuarial, scientific, medical or public policy research; grievance procedures, audits, etc). Information is shared with entities (i.e. providers and vendors) that assist AIS in supplying products and services to our members or that promote products and services on behalf of our contracted carriers. Information is provided to nonaffiliated third parties as required or allowed by federal and state law. AIS maintains physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.

If you have requested a face to face appointment or a phone visit with a licensed agent, we reserve the right to disclose personal information to that particular agent.  The following information may be shared, but only on a need to know basis, in compliance with all applicable HIPAA laws:

  1. name, address and telephone number;
  2. date of birth;
  3. current policy coverage, benefits, premiums history; and
  4. limited medical information

Retention of Information Collected:

Any non-public, personal information collected and maintained from this Web site will be retained for a minimum of six years from the date the information is received unless you perform a function on our Web site that requires the use of this information at a later date. In that case, the information will be retained for a minimum of six years from the date the information was last used in a function on the Web site. When required by federal or state law, there may be some instances in which your information will be retained longer than six years.  In no case will it be kept for more than 10 years.

Use of Cookies:

A “cookie” is a mechanism that permits a Web server to send small pieces of information or text through your browser to be stored on your hard drive. This information or text allows the server to identify frequent visitors and enhance the user’s experience on the Web site.

AIS may collect information through the use of cookies in order to enhance navigation of the site, to direct you to appropriate pages, analyze user behavior and for session security and timeout purposes. In general, cookies used on this site are active only during your site session.  We do use some persistent cookies, i.e, they can be stored on your computer. Persistent cookies used on this site—ones that are active beyond the session and are stored on the system—are only used for gathering information about our users’ computers, such as operating system, browser type, and software versions in order to enable proper performance of the site and to track some user behavior.  We can use clear GIF cookies is some parts of our system.  Our cookies are not utilized to send unsolicited e-mail or provide us with the user’s personally identifiable information. The information collected in these cookies is not linked to your personal health information.   We do not share information collected through cookies with third parties.

Your browser software can be set to disallow all cookies. Instructions on setting your browser to reject cookies are usually located in the “Help” section of the toolbar, depending on your browser type. If you choose not to accept our cookies, you should still be able to access most of the public areas of our site, although some of the features of interactive sections may be limited, and we will not be able to authenticate you for the non-public secure sections where a logon is required.

 

Spyware:

Spyware refers to types of software programs, downloaded to a consumer’s personal computer either as a stand-alone application or as part of a software bundle, that collect (i) information about a consumer’s internet activities or (ii) other personal information, without providing meaningful notice to the consumer or obtaining the consumer’s consent. Spyware may gather personally identifiable information, such as e-mail addresses and credit card information, and may even alter personal computer settings. Spyware is often extremely difficult to remove once installed.  AIS  believes that Spyware is a threat to consumer privacy and forbids any employee, agent, partner, affiliate or contractor to deploy or use Spyware.

Direct Access to Other Sites:

Armorhealth.com maintains direct links to other separate and individual web sites that offer information, which could be beneficial to our clients. Since these direct links are separate web sites independent of Armorhealth.com, they may not follow the same privacy guidelines set forth here.  AIS assumes no responsibility or control over the acts or privacy policies of the third party web sites to which AIS provides direct links. We suggest that you contact the appropriate controlling authorities of these sites or review their privacy policy.

 

Opt-Out

AIS provides its members and users the opportunity to ‘‘opt-out’’ of having their information used for purposes not related to the AIS Web site when AIS requests such information. Users who wish to opt-out can do so by sending an e-mail to info@armorhealth.com with the subject line: OPT OUT. Or you may call 1-800-922-2789 and request to be taken off of our electronic mailing list.  This only applies to information collected during the web site registration process and does not affect information obtained by AIS by any other means. AIS will not use your information collected by the AIS Web site for marketing purposes unless allowed by State and Federal Law.

Correction/Updating Personal Information

If the personally identifiable information of a user of our services changes or a group’s information changes, or if the user or group no longer desires to use the services on this web site, AIS will endeavor to provide a way to correct, update or remove that user’s personal data. Personal data that is removed from our systems cannot be removed from backup files stored prior to your request. To correct or update personal information, contact AIS administration at 1-888-922-2789.

Security

AIS takes precautions to protect its users’ personal non-public information. When users submit sensitive information to AIS, the information is protected both online and off-line.

While AIS uses SSL encryption to protect sensitive information online, AIS protects user-information off-line. Only employees who need the information to perform their jobs are granted access to personally identifiable information. AIS employees must use password-protected screen-savers when they leave their desk. When they return, they must re-enter their password to re-gain access to your information. Furthermore, all employees are kept up-to-date on AIS security, privacy practices, HIPAA, PHI and PII practices. Finally, the servers that store personally identifiable information are kept in a secure environment.

AIS Reserves The Right To Modify Its Privacy Policy

AIS reserves the right to change or update this Privacy Policy at any time. Any changes made to our privacy policy will be posted on this site in a manner that is easily identifiable. Please review our privacy policy on a regular basis to review any changes.

User Agreement

This Usage Agreement (“Agreement”) is entered into by and between Armor Insurance Services, LLC. (“AIS”) and you, the user (“you”, “your”, or “user”), and governs your use of this website (“armorhealth.com” or “freemedigapkit.com” or “Website” ).  This Agreement also applies to your use of AIS HTML, e-mail and web page micro-sites.  Herein referenced as armorhealth.com” or “website”.

BY USING THIS WEBSITE OR THE SERVICES AVAILABLE ON THIS WEBSITE, YOU AGREE TO THE TERMS OF THIS AGREEMENT JUST AS IF YOU HAD SIGNED THE AGREEMENT. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, YOU MAY NOT ACCESS THIS WEBSITE OR USE ANY OF THE SERVICES AVAILABLE THROUGH THIS WEBSITE
AIS’ is an independent general insurance agency that represents multiple insurance companies.  We are paid a commission for providing sales and administrative services on policies  that are active and in-force.

1. License. AIS hereby grants you a limited, non-exclusive, non-assignable and non-transferable license to access and use the on-line services available at Armorhealth.com subject to the terms of this Agreement.

2. Access. Certain restricted sections of Armorhealth.com will be accessible only to you or your personnel identified to AIS. All information about users provided to AIS must be current, accurate, and complete. If AIS at any time discovers any error or omission in the information that you provide, AIS may, at its option, terminate the right to access and use the password protected sections of Armorhealth.com by any user. You are responsible for the acts or omissions by your personnel’s use of Armorhealth.com, and for any damages incurred by you as a result thereof. You may be asked to accept additional terms and conditions prior to enrolling in or using certain restricted services offered through Armorhealth.com.

3. Agency Access. Certain services offered through Armorhealth.com will be accessed and used by  authorized agents of AIS and authorized members of their staff. If you are an agent, or an agent’s authorized representative, it is your sole responsibility to identify members of your staff who should be permitted to access and use Armorhealth.com, and to authorize, monitor and control access to and use of Armorhealth.com by your staff members.

4. Information.
A. The term “Information” shall mean all content, data and the related subscriptions, products, services and information obtained through Armorhealth.com. AIS has entered into agreements with certain insurance companies, sponsors, third-party web site operators and other third-party providers whereby AIS displays information, products, goods, or services offered by the third-party providers and sometimes provides links from Armorhealth.com to third-party web sites (the foregoing third-party providers are collectively referred to as “Third-Party Providers”). The term “Information” also refers to Information which is offered by Third-Party Providers.

    5. Ownership.
    The Information found on all pages of Armorhealth.com is the property of AIS or its licensors, licensees or Third-Party Providers and most Information is copyrighted material. The logos, page headers, custom graphics, buttons, and other icons contain or are proprietary service marks, trademarks, or service marks of AIS (collectively, “Trademarks”) or of our Third Party Providers.. Nothing in this Agreement shall be construed as transferring or assigning any ownership rights to you or any other person or entity in the Information or Trademarks.

  2. Restrictions. Only personal use of the Information is permitted, which means that you may access, download or print such Information for your personal, non-commercial use only. You agree not to change or delete any copyright or proprietary notice from Information downloaded from this Website or any website accessible through this Website. You may not resell, redistribute, broadcast or transfer the Information or Trademarks or use the Information in a searchable, machine-readable database or file. You agree to use Armorhealth.com and the Information for lawful purposes only.     13. Equipment and Operation. You shall provide and maintain all software, computer hardware, Internet connection and other equipment and services necessary to access Armorhealth.com, and the costs of any such equipment and/or connections or use, including any applicable taxes, shall be borne solely by you.

YOU AGREE TO RELEASE, INDEMNIFY AND HOLD HARMLESS AIS, ITS LICENSORS, AND THIRD-PARTY PROVIDERS (INCLUDING THEIR OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, REPRESENTATIVES OR CONTRACTORS) FROM AND AGAINST ALL CLAIMS, DAMAGES, LAWSUITS, JUDGMENTS AND EXPENSES (INCLUDING REASONABLE ATTORNEY’S FEES) RESULTING FROM ANY CLAIM BROUGHT BY ANY PERSON ARISING FROM OR RELATING TO YOUR NEGLIGENT OR WRONGFUL ACCESS OR USE OF ARMORHEALTH.COM, AND THE INFORMATION, SERVICES AND/OR PRODUCTS OBTAINED THROUGH OR PROVIDED BY ARMORHEALTH.COM OR YOUR POSTING ANY CONTENT ON THE WEBSITE.

    17. Privacy. You hereby acknowledge having read and accept and agree to all terms and conditions of AIS’s Privacy Policy, also found at Armorhealth.com, which are hereby incorporated in this Agreement.

    18. No Conflicting Terms. If there is any conflict between this Agreement and any other documents regarding the subject matter of this Agreement or the services, products or Information you access, acquire or receive through Armorhealth.com, then the provisions of this Agreement shall govern, whether such other documents are prior to or subsequent to this Agreement, or are signed or acknowledged by any director, officer, employee, representative or agent of AIS.

    19. Minors. If you have agreed to allow your minor child or a child for whom you are legal guardian (“Minor”) to access Armorhealth.com or any of the services or Information offered or through the site, you agree that you shall be solely responsible for: (a) the on-line conduct of such Minor; (b) monitoring such Minor’s access to and use of the site; and (c) the consequences of any use of the site by such Minor.

    20. Attorney’s Fees. Should litigation, arbitration or other legal action arise from this Agreement, the prevailing party shall be entitled to recover from the non-prevailing party, in addition to all sums to which it is entitled or any other relief, at law or in equity, reasonable attorney’s fees and costs of litigation.

    21. Governing Law; Venue. This Agreement shall be governed by the laws of the State of Texas excluding any rule or principle that would refer to and apply the substantive law of another state or jurisdiction. Any such claim or cause of action may only be brought in the state or federal courts located in Dallas, Texas and you agree to submit to the exclusive personal jurisdiction of such courts and hereby appoint the Secretary of State of the State of Texas as your agent for service of process. You agree to waive any objection that the state or federal courts of Texas are an inconvenient forum.

    23. Waiver. AIS’s failure to insist upon strict enforcement of any provision of the terms and conditions of this Agreement shall not be construed as a waiver of any such provision or right.     24. Assignment. You may not assign any of your rights, obligations or privileges hereunder without the prior written consent of AIS. Any assignment other than as provided for in this Section shall be null and void, ab initio.

    25. Severability. If any provision of this Agreement is found to be unlawful or unenforceable in any respect, the court shall reform such provision so as to render it enforceable or, if it is not possible to reform such provision so as to make in enforceable, then delete such provision. As so reformed or modified, the court shall fully enforce this Agreement.

    26. Entire Agreement. THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN THE PARTIES, AND NO OTHER AGREEMENT, WRITTEN OR ORAL, EXISTS BETWEEN YOU AND AIS WITH RESPECT TO THE SUBJECT MATTER ADDRESSED HEREIN.

    27. Modification to this Agreement. AIS may modify this Agreement at any time, and such modifications shall be effective immediately upon posting of the modified terms and conditions. Accordingly, you agree to review the terms and conditions periodically, and your continued use of this Website shall be deemed your acceptance of the modified terms and conditions.

    28. Child Online Protection Act Notification. Pursuant to 47 U.S.C. Section 230(d) as amended, AIS hereby notifies you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material that is harmful to minors. What is 128-bit encryption?

Encryption is the process of converting plain text into scrambled code to help to safeguard the transmission of confidential data. Most browsers use 40-bit encryption. Encryption at 128-bit strength provides a significantly greater amount of cryptographic protection.

The numbers “128” and “40” refer to the size of the key used to encrypt the message. With hackers gaining increasing computing power, it is necessary to employ larger keys than has been needed in the past. To compare the two, 128-bit encryption is approximately 309,485,009,821,345,068,724,781,056 times stronger than 40-bit encryption.

If you choose to upgrade your current browser, you can find patches or updated browser versions with 128-bit encryption on the home web site of your current browser supplier.
